Who Can Qualify for Spousal Support in Texas?

In order to qualify for spousal support, one must meet certain requirements, per Texas law. Firstly, a judge must determine that the spouse seeking alimony will not be able to meet his or her basic needs at the time of divorce.

Secondly, one or more of the following circumstances must be present:

  • The marriage lasted at least 10 years, and the spouse seeking alimony is not able to support him or herself financially
  • The spouse seeking alimony cannot provide for him or herself due to a mental or physical disability
  • The spouse seeking alimony cannot earn enough income to support him or herself due to the special needs of a child of the marriage over which the seeking spouse has custody
  • One spouse has been convicted of domestic violence against the other spouse or their child during the marriage or during divorce proceedings
